Privacy Policy
1. Our Commitment
Color Sampling (“we” or the “App”) is committed to protecting your privacy. This Privacy Policy aims to
clearly and transparently explain how we collect, use, store, share, and protect your personal information
when you use our color collection and inspiration management tools, and outlines your related rights. We are
committed to complying with applicable U.S. privacy laws and regulations, including the California Consumer
Privacy Act (CCPA).
2. Information We Collect
To provide you with our core services, we need to process the following information. We collect
information following the principle of minimum necessity.
The content you actively provide and create is the core of the service. This includes images you take
using the App or import from your photo album, and color values (such as RGB, CMYK, or hexadecimal color
values) automatically analyzed and extracted from these images by the App. Additionally, this textual
information is also saved when you add tags, notes, or create projects for color records. This information
is necessary to fulfill the service contract.
To ensure the stable and secure operation of the App and to continuously improve the product, we
automatically collect partially anonymized technical information. This information may include your device
type, operating system version, unique device identifier, application version number, and anonymous usage
data (such as feature click frequency and session duration) and crash reports. Processing this information
is based on our legitimate interest in improving service quality and security.
Some functions require you to grant us access to specific device permissions. The most crucial are camera
and photo library permissions, which are fundamental for taking and importing images. Additionally, we offer
an optional feature: with your explicit consent, the application can access your device's coarse location
information (such as city or street level) to add contextual geotagging to the colors you collect. You can
disable these permissions at any time in your device's system settings.
3. How We Use Your Informatio
Your information will only be used for the following explicit purposes: First, to provide, maintain, and
improve our core services, such as performing color analysis and managing your personal inspiration library
and project palettes. Second, to ensure the security of our services, such as detecting and preventing fraud
and abuse. Finally, in compliance with legal obligations, to respond to lawful requests from law enforcement
or other government agencies.
4. How We Share Your Information
We solemnly declare that we will never sell your personal information. We may share information with third
parties only in limited and necessary circumstances: We may engage contractually bound third-party service
providers to assist us in storing data or analyzing overall product usage trends. These providers may only
process data as directed by us and must provide the same level of security protection. In certain
exceptional circumstances, we may disclose information as required by law or to protect our and others'
legitimate interests (such as preventing serious personal injury or investigating fraud). Furthermore, in
the event of a merger, acquisition, or sale of assets, your information may be transferred as part of the
transaction, and we will ensure that the transferee continues to comply with this Privacy Policy.
5. Your Data Security
We employ industry-standard physical, electronic, and managerial measures to protect your information from
unauthorized access, disclosure, alteration, or destruction. These measures include encrypted data
transmission, secure server storage environments, and strict internal data access control processes. Despite
our best efforts, no security measure is perfect, and we cannot guarantee absolute security of information.
6. Your Privacy Rights
Under laws such as the California CCPA, you have several rights regarding your personal information. You
have the right to know what personal information we collect and how it is used and shared. You have the
right to access and obtain a copy of your personal information. You have the right to request that we delete
the personal information you provide. You have the right to opt out of the “sale” or “sharing” of your
personal information for “commercial purposes.” You have the right to be free from discrimination when
exercising these rights, and we will not reduce the quality of our service to you as a result.
7. Data Retention and International Transfer
We retain your personal information only for the period necessary to achieve the purposes described in
this policy. You can delete your color records and items at any time within the application. Upon account
cancellation, we will delete your personal data, unless otherwise required by law or regulation. Our
services are primarily operated in the United States, and data is stored on servers in the United States. If
future data transfers to other jurisdictions are necessary, we will ensure adequate protection through legal
mechanisms such as standard contractual terms.
8. Children's Privacy
Our services are not designed for children under the age of 13. We do not knowingly collect personal
information from children under the age of 13. If we discover that we have unintentionally collected such
information, we will take immediate steps to delete it. We comply with the U.S. Children's Online Privacy
Protection Act (COPPA).
9. Changes to the Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in law, technology, or business
practices. After an update, we will post the new policy within the app and update the effective date. For
significant changes, we will notify you through prominent means such as in-app notifications. Your continued
use of our services indicates your acceptance of the updated policy.
